These terms and conditions apply to the American Eagle Furniture Properties and Products. Terms and conditions also apply to the American Eagle Furniture web site located at www.aefurniture.com , and all associated sites linked to www.aefurniture.com. The site is the property of American Eagle Furniture and its licensors. By purchasing and/or using American Eagle Furniture’s website, you agree to the terms and conditions of American Eagle Furniture. Terms & conditions are subject to change without prior notice.

Notice to Vendors & Public: We are a wholeseller not open to the public. Prices and purchasing are only to businesses & vendors with approved accounts by American Eagle Fruniture. Public inquaries can be made regarding product details and availablility; however, American Eagle will not have inforamtion on pricing or have the ability to purchase from us directly. This informaiton will be rerouter to businesses & vendors with active accounts in the nearest and neighboring zones availble.

PAYMENT TERMS

All orders must be paid either by check, cash or a cash instrument - money order, bank checks, wire transfer, direct deposit or credit/debit card. There will be no exceptions. If you choose to pay by wire transfer, please contact our account receivable department to obtain the necessary routing information.

If you choose to pay by check, all check information must match the business name and address on the account. Checks must be clear before orders are shipped.

Note: We are not able to return cash if the check amount is greater than the order. The difference will be credited to your account. We do not accept personal checks.

Returned & NSF Checks (Non-Sufficient Fund):All returned checks are subject to a $45.00 fee. The account will be placed on hold until the returned check is paid either by cash, money order, bank check or wire transfer. After receiving an NSF check, the account will be placed on a cash basis for the next 6 (six) purchases. They are to be paid either by cash, money order, bank check or wire transfer – no exceptions. Should there be a second NSF check the account will be placed on a “cash only” basis indefinitely. If a check is returned in error by your bank, a letter from your bank is required before we will once again honor your checks.

 

MINIMUM ORDER:

$1000 is the minimum for all delivery orders. No minimum for will call orders.

 

DELIVERY

Free local delivery to commercial areas only with a minimum order of $1000 within 50 miles from our warehouse located in the City of Industry, CA. Delivery dates vary based on orders and their areas. Companies will be scheduled according to the orders available. Confirmations will be made in advance, but subject to change. Please contact American Eagle Furniture for more details.

 

SPECIAL ORDERS:

Special orders are limited to colors and existing pieces that are not modified, such as added features or resizing to products. Special orders also differ in cost compared to the price list, due to different materials or color. The order will only place once the deposit is made. It will take approximately 8-12 weeks to arrive. Shipping might be delayed due to port congestion, shortage of materials or manufacturer’s holidays. Time frames are estimated and are subject to change.

 

BACK ORDERS:

Items not in stock, discontinued, or listed as special order may be back order. Please contact our office for more details.

 

DIRECT IMPORT PROGRAM

Please contact us for quotations and information regarding our direct import program.

 

COLLECTION FEES

Should the account go into collection you will be responsible and charged for all collection fees.

 

RETURNED MERCHANDISE:

  • No merchandise returns will be accepted without prior authorization and a return authorization number from American Eagle Furniture. Any returns without an authorization will be refused by the warehouse.
  • We will accept the return of any UNOPENED PRODUCT, THAT IS IN ORIGINAL PACKAGING without any damage within 7 days of the delivery received date for credit toward your account.
  • There will be 20% RESTOCKING FEE.
  • Claims for defective, wrong merchandise or missing parts must be made within 14 days.
  • Any damage claims in transit must be made against freight carrier and/or trucking company. Before signing the freight bill, please inspect all the boxes for damages and make sure the carrier has signed on the freight bill for any damages.
  • We DO NOT provide payment for RETURN SHIPPING except for order processing irregularities.
  • Pictures are required to claim defective merchandise with a copy of the invoice. Requests can be processed with our customer service department or by email to rma@aefurniture.com
  • Customer’s are responsible for any/all transportation costs for all returned merchandise regardless if it is defective, damaged, or requires inspections for any service’s issued or requested.
  • Not all returns are accepted and are subject to case by case review.
  • Any exchange for defective merchandise will be shipped with the next order to the customer’s warehouse or can be pick-up if the inspection is completed and approved.

 

REPLACEMENT PARTS:

Requests for replacements must include your original invoice. Please indicate which items and quantities are needed. All replacement parts or spare part orders are subject to American Eagle Furniture’s Terms and Conditions of Sale.


 

LIMITED WARRANTY TERMS

If a manufacturing defect is found, American Eagle Furniture should be notified promptly of the defect and supplied a copy of the invoice and delivery ticket. Inspection by an American Eagle Furniture employee or representative may be necessary to verify that a manufacturing defect exists, or you may be required to submit samples to American Eagle Furniture along with a digital image of the defects. If replacement is required in accordance with this limited warranty and the defective material or merchandise has been discontinued or unavailable, American Eagle Furniture reserves the right to select and supply a similar merchandise or offer full or partial credit for the merchandise in case by case basis; otherwise the same material or merchandise will be supplied for replacement purposes. Please see below for additional warranty terms for upholstery products. American Eagle Furniture limited warranty terms are subject to change without prior notice.

This limited warranty is made solely to the retailer and is not transferable under any circumstances. It is the retailer’s responsibility to contact American Eagle Furniture with a claim. We will not handle claims from consumers directly; all requests must go through the retailer who sold the merchandise to the consumer. American Eagle Furniture will not honor 3rd party warranty(s) or extended warranty(s) that the store may provide their customer at the time of purchase. Additional or extended warranty (s) will then become the retailers sole responsibility. We advise all retailers to retain invoices for a minimum of one (1) year for warranty purposes.

Notice to public: We are a whole seller and not open to public. For any service or warranty claims, regardless of the situation, please report to the original retail or online store where you made your purchase. American Eagle Furniture cannot honor any service or warranties to the public even with a record of transaction. We require cooperation of the store to confirm and authenticate records and product. Thank you for your understanding.

 

ADDITIONAL CONDITIONS

The following examples are not manufacturer’s defects:

  • Colors may vary slightly from the photo because of photography and printing tolerances.
  • Foam will soften slightly.
  • Sizes are stated in U.S. standard measurements while the actual sizes are manufactured using the metric system therefore the sizes may vary slightly.
  • There are no exchanges or refunds on any pillows or toppers or mattress’s sold.
  • No returns for buyer’s remorse.
  • Markings or dirt accumulated during manufacturing or transportation.  

Warranty is void for any of the following conditions:

  • Improper maintenance or improper use resulting in damage.
  • Any product modifications/repair work by dealer, consumer, or other parties not authorized by American Eagle Furniture will void this warranty.
  • Floor samples sold or products designated "AS IS" at the time of purchase are not covered by the warranty.
  • Warranty does not cover markings / stains/ dirt / discoloration after use or caused during transportation or relocation.
  • Warranty does not cover minor variations or differences between floor samples or printed illustrations and your furniture.
  • Cost of packaging and shipping to and from American Eagle Furniture is not covered by the warranty unless expressly arranged by American Eagle Furniture.
  • This warranty covers only articles of furniture intended for residential use only, does not cover any industrial, commercial, institutional, or rental use.
  • Dissatisfaction due to buyer’s remorse.
  • Fragile material such as Glass and Marble that is damaged after use.
  • Normal wear and tear.
  • Damages incurred during transportation.
  • Damages incurred during assembling or maintenance.
  • Damages incurred by accidents or abuse.

 

LIMITED WARRANTY FOR AMERICAN EAGLE COLLECTIONS, AE DESIGNS & EAGLE KING COLLECTIONS SOFAS

American Eagle warrants to the original consumer purchaser of this product, purchased at retail, while the product is at the original delivery address of the retail consumer, based on reasonable use the following:

WARRANTY FOR TOP-GRAIN ITALIAN LEATHER, SKU(S) BEGINNING WITH  "EK-":

  • 1-YEAR LIMITED WARRANTY – SOFA CUSHIONING
    American Eagle warrants the cushions in its upholstered products to be free from abnormal loss of resiliency for a period of one (1) year.

    The flattening of the fiber or foam materials used in cushioning that occurs due to normal use is considered a normal loss of resiliency. Normal loss of resiliency is not a defect in materials or workmanship and should not be confused with abnormal wear or abnormal loss of resiliency, and is not covered by this limited warranty.
  • 1-YEAR LIMITED WARRANTY – SOFA LEATHER AND STITCHING
    American Eagle warrants the leather used to be free from tearing and splitting under normal use for a period of one (1) year from the date of purchase to the retail consumer. American Eagle also warrants the stitching in its upholstered products to be free from defects in materials and workmanship for a period of one (1) year.

    The inherent beauty of leather is due to variations in grain, texture, color tones, and its natural characteristics which contribute to the uniqueness of each upholstered leather product. Because leather is a natural product, this limited warranty does not cover natural characteristics of leather, such as markings caused by insect bites, barbed wire, veining, abrasions, injuries to the animal, wrinkling, or variations in grain or color tones on different sections of the same leather product. This warranty also does not cover normal wearing, durability and color fastness of leather. This warranty also does not cover mistreatment of the product, stripping, color fading, and discoloration due to chemical applications, accidental or malicious staining or vandalism. Using any after-market leather treatment on the leather will void the leather warranty of this product.
  • 1-YEAR LIMITED WARRANTY – MECHANISMS
    American Eagle warrants the metal mechanisms in its upholstered products to be free from defects in materials and workmanship for a period of one (1) year.

WARRANTY FOR FAUX LEATHER, BONDED LEATHER, MICRO-FIBER LEATHER, GENUINE LEATHER, AND FABRIC SOFAS, SKU(S) BEGINNING WITH  "AE-":

  • 6 MONTHS LIMITED WARRANTY – SOFA STITCHING
    American Eagle also warrants the stitching in its upholstered products to be free from defects in materials and workmanship for a period of six (6) months.
  • 6 MONTHS LIMITED WARRANTY – MECHANISMS
    American Eagle warrants the metal mechanisms in its upholstered products to be free from defects in materials and workmanship for a period of six (6) months.
  • LEATHERS & FABRICS: FAUX LEATHER, BONDED LEATHER, MICRO-FIBER LEATHER, GENUINE LEATHER, AND FABRIC(S) SOFAS
    The Limited Warranties on “B” Grade leather, Upholstered Fabric, and Bonded & Man-Made leather or finishes and all other furniture products are not covered by American Eagle. Any service(s) requests for these materials will be treated case by case at American Eagles discretion.

NO WARRANTY FOR FRAGILE PARTS OF ALL FURNITURE, SUCH AS BUT NOT LIMITED TO MARBLE AND GLASS.

LIMITED WARRANTY EXCLUSIONS AND CLARIFICATIONS

These warranties are extended by American Eagle only to you, the original consumer purchaser at retail, and to no other person. This limited warranty is not transferable.

This limited warranty does not apply to any American Eagle upholstered products used for any commercial, contract, institutional, rental-trade, or other non-household use. Limited Life-time warranty does not apply to cover damages incurred during the transportation of the product. Does not apply to damage resulting from misuse, abuse, neglect, cuts and scratches, accident, burns, fire, water or other hazard, shipment after original delivery to original retail purchaser, exposure to direct sunlight or bright lights or extreme heat or similar conditions resulting in discoloration, cracking or peeling of leather coverings. This limited warranty does not cover mistreatment of the product dues to stripping, color fading, and discoloration due to chemical applications, accidental or malicious staining or vandalism. Limited Life-time warranty does not apply to floor samples or to sales made on an "as-is" basis. 

 

LIMITATIONS AND EXCLUSIONS

Although American Eagle stands by its Limited Warranty, there are some limitations and exclusions.

If a American Eagle upholstered product does not conform to these limited warranties, your sole and exclusive remedy is (i) repair of any defective product or repair of any part of any product determined to be defective; (ii) replacement of any defective product or replacement any part of any product determined to be defective; or (iii) refund of the original purchase price paid by you for the defective product upon return to American Eagle of the defective product. American Eagle will pay the cost of labor to repair or replace defective parts.

 

ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THE EXPRESS LIMITED WARRANTIES SET FORTH FOR THE AMERICAN EAGLE UPHOLSTERED PRODUCT FRAMES, CUSHIONING, LEATHER AND STITCHING, MECHANISMS, AND SOFA BED PARTS SET FORTH IN THIS LIMITED WARRANTY.

No other express warranty has been made or will be made on behalf of American Eagle Furniture, with respect to the furniture and its parts, or the operation, repair, or replacement of the furniture and its parts. Furthermore, No Representative of American Eagle Furniture or its Distributors or Retailers is authorized to make any changes or modifications to these limited warranties.

Some retailers offer extended or additional warranties, including but not limited to extended or additional fabric warranties, either from the retailer or through a third-party. American Eagle Furniture shall not be liable under any extended or additional warranties offered by any retailer or through a third-party.

Third-party service/repair work by a technician or repairman,  American Eagle Furniture shall not be liable under any extended or additional work offered by any retailer or through a third-party without prior approval from American Eagle Furniture. Any work done to the product without approval from American Eagle Furniture voids all warranty(s).

In the event shall American Eagle Furniture be responsible for consequential or incidental damages, such as, loss of use, inconvenience, loss or damage to personal property, weather direct or indirect, and weather arising in contract or tort. In not event shall American Eagle Furniture’s responsibility exceeds the purchase price of the product of its replacement.

The limited warranties and remedies are exclusive and are in lieu of all other warranties and remedies, verbal or written, express or implied.  Some states do not allow an exclusion or limitation on how long an implied warranty lasts, so the above limitations may not apply to you.

If any material or parts used in any defective product is unavailable at the time of repair, if American Eagle elects to repair the defective product, American Eagle reserves the right to substitute materials or parts of equal quality and value as determined in the sole discretion of American eagle.

 

AMERICAN EAGLE SHALL IN NO EVENT BE RESPONSIBLE TO YOU FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF TIME, USAGE, OR MONEY AND IN NO EVENT SHALL THE RESPONSIBILITY OF AMERICAN EAGLE FOR ANY DEFECT EXCEED THE PURCHASE PRICE PAID BY YOU, THE ORIGINAL CONSUMER PURCHASER AT RETAIL, FOR THE PRODUCT. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

 

TO VALIDATE YOUR CLAIM UNDER THIS LIMITED WARRANTY

Claims should be made by the original consumer purchaser through the retailer from whom the American Eagle upholstered product was purchased. To obtain performance of these limited warranties, you must specifically do and provide the following:

  1. Submit to the retailer a written limited warranty claim form containing the product identification number located on your retail sales receipt and a copy of a dated proof of purchase of the product. 
  2. Submit to the retailer with the written limited warranty claim three photographs:
    1. a photograph of the American Eagle upholstered product;
    2. a photograph of the label attached to the dust cover underneath the product;
    3. a photograph(s) of the claimed defect(s).
  3. Submit to the retailer any report of an independent technician reviewing the claimed defect(s).
  4. Make limited warranty claims to the retailer for defects visible when you first received the product within forty-eight hours after you received the product.
  5. Make limited warranty claims to the retailer promptly following the discovery of any alleged defect, but no later than seven (7) days after the alleged defect should have been discovered by you.

 

American Eagle and retailers selling American Eagle upholstered products will not accept a limited warranty claim from an original consumer purchaser at retail that fails to include all of the information requested in sections (a) and (b) above. 

After reviewing your warranty claim, the retailer may determine that it is necessary to send a technician to review the alleged defect.  The technician will review the defect and conduct appropriate tests or take additional photographs of the furniture for submission to American Eagle.  If a retailer determines that it is necessary to have a technician review the alleged defect, you must cooperate with the retailer and the technician by providing information regarding your use of the furniture, and providing access to the furniture for testing, review, and photographing. 

If the appropriate claim information is provided, the retailer will contact American Eagle for warranty service if it makes the determination that the claimed defect is covered by this limited warranty.  The retailer will then submit your written limited warranty claim, photographs, and any independent technician reports to American Eagle for consideration and approval.

American Eagle has the sole right to determine whether a claim is covered by this limited warranty. All determinations regarding claims will be made within 30 days from receipt by American Eagle of the claim. If a claim is approved, American Eagle will fulfill its limited obligations to repair or replace the product as set forth herein within a reasonable time period.

 

This warranty does not cover packaging, shipping or transportation costs to and from the manufacturer, retailer or other repair point as required by American Eagle. These costs remain the responsibility of you, the original consumer purchaser at retail.

 

OTHER LEGAL RIGHTS

This limited warranty gives you, the original retail purchaser, specific legal rights, and you may also have other rights which vary from state to state.
